Marriageable age :-

Both parties must have completed 15 years (age of puberty)          

 Marriage is regarded as contract

What are the essential rites?

-Proposal and acceptance, two witnesses as per Shariat

What are the essential conditions?

                        -Both parties must be Muslims or a Muslim man and a Kitabiyan (women)
                        -Sound mind and valid consent
                        -Meher
                        -Presence of two witnesses
                        -Not within degrees of prohibited relationship,consanguinity, affinity and fosterage 
                        -No spouse living at the time of marriage
                        -Up to four wives, if in a position to maintain them equally

Is the Registration Compulsory?

-Optional as per this particular law.

Where to register?

– Nikahnama is the marriage certificate but can be registered with the registrar of marriages

By whom?

– Marriage Registrar

What makes the marriage invalid?

           * Marriage with a fifth wife (irregular-no legal sanctity) 
           * Within prohibited degree of relationship
           * Ceremonies not performed (irregular)
           * Impotency / non consummation
           * Unlawful conjunction (irregular) 

Exclusive ground for husband ?

-As per Shariat Law


Restitution of Conjugal Rights (Approach the Court for a direction to make the other party to come and live the petitioner)

Who can apply?

Either husband or wife


When can you claim?

If one withdraws from other's society without reasonable cause (desertion)

What are the grounds available?

                             -Dissolution of Muslim Marriages Act, 1939
                             -Cruelty
                             -Desertion for at least two years
                             -Incurable of unsound mind for a continuous period of not less than two years
                             -Veneral disease in a communicable form for not less than two years
                             -Disappearance for four years leading to presumption of death
                             -Conversion to another religion 
                             -Option of puberty
                             -Husband imprisoned for seven years or more
                             -Willful refusal to consummate the marriage
                             -Impotency / non consummation
                             -Failed to pay maintenance for two years
                             -Failed to perform his marital obligations for three years 

What are additional grounds for wife ?

-Guilty of rape, sodomy, bestiality

Exclusive ground for husband?

-Nil

Mutual Consent Divorce
